Acceptance of the Terms

By accessing or using the WS Design Concierge application (the "Application"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you should not access or use the Application.

Eligibility

You must be at least 18 years of age to use the Application. By using the Application, you represent and warrant that you meet this requirement.

Description of WS Design Concierge

WS Design Concierge is a renovation visualization and lead engagement tool operated for WS Design & Build. The Application allows users to:

• Create renovation Project Profiles
• Complete a Design Journey
• Upload room and inspiration images
• Generate AI-assisted renovation concepts
• Select favorite concepts
• Create Project Vision Reports
• Contact WS Design & Build

Homeowner Email Access

WS Design Concierge currently uses lightweight, email-based access. Homeowners enter their email address to access saved projects. The Application does not currently require a password, magic link, or verification code.

You are responsible for maintaining the security of your email access. You should avoid using the Application on shared or public devices without signing out when finished. WS Design & Build may introduce stronger verification methods in the future. The current email-only system does not provide the same level of security as password-protected authentication.

Permitted Use

You may use the Application for personal renovation planning purposes, including creating projects, exploring design concepts, and contacting WS Design & Build about your renovation project.

Prohibited Use

You agree not to:

• Attempt to access another homeowner's projects or data
• Use multiple email addresses or devices to evade generation limits
• Submit automated or excessive generation requests
• Reverse engineer, decompile, or disassemble the Application
• Interfere with application security or infrastructure
• Upload malware, viruses, or harmful files
• Use generated content for illegal, deceptive, or harmful purposes
• Misrepresent an AI-generated concept as an approved construction plan
• Attempt to access API keys, credentials, or private administrator tools
• Use the service in a way that harms WS Design & Build or third parties

Project Information and Uploads

Rights to Uploaded Content

You confirm that you have the permission and rights to upload all images and information you submit through the Application. You should not upload:

• Images you do not have permission to use
• Illegal content
• Harmful files or malware
• Sensitive personal documents
• Private information unrelated to the renovation project
• Content that violates another person's rights

You retain ownership of your original uploaded content. By submitting content, you grant WS Design & Build and its service providers a limited permission to host, process, resize, analyze, and use the content only as needed to operate the Application, provide renovation services, communicate with you, improve the service, maintain security, and comply with legal obligations.

AI Generated Renovation Concepts

No Professional or Construction Guarantee

AI-generated renovation concepts are preliminary visualizations only. They are not:

• Architectural drawings
• Engineering drawings
• Permit documents
• Construction plans
• Professional measurements
• Product specifications
• Binding estimates
• Guaranteed representations of completed work

AI-generated content may:

• Misrepresent dimensions
• Change architectural details
• Show unavailable materials
• Include visual inconsistencies
• Suggest features that may not be feasible
• Require professional review

No renovation decision should be based solely on an AI-generated image. WS Design & Build must review the actual property, measurements, structure, utilities, materials, budget, and local requirements before confirming any renovation plan.

Design Session Limits

Credit Reservations and Refunds

A Design Session is reserved when a homeowner begins a Design Journey under the current application rules. A reserved Design Session may become consumed when the project is submitted for generation.

Key terms regarding Design Sessions:

• An eligible unfinished project deleted before generation may return its reserved session credit
• Completed, submitted, generating, or generated projects are generally not eligible for a session refund
• Administrators may manually adjust session access
• Session limits and eligibility may change
• Unlimited generation access is not guaranteed unless specifically granted

User Responsibilities

You are responsible for the accuracy of the information you provide and for all activity that occurs under your email session. You agree to use the Application in compliance with all applicable laws and regulations.

Communications Consent

When you accept the contact agreement, you authorize WS Design & Build to contact you regarding:

• Your renovation project
• Saved concepts
• Requested services
• Follow-up questions
• Potential consultations
• Related WS Design & Build services

Message and data rates may apply where applicable. You may update your communication preferences at any time by contacting design@wsbuild.com.

Intellectual Property

The Application, including its design, content, and software, is owned by WS Design & Build and is protected by intellectual property laws. AI-generated concept images are provided for your personal planning use and are not for commercial redistribution without permission.

Third Party Services

The Application may use third-party providers for cloud hosting, file storage, email delivery, application infrastructure, analytics, artificial intelligence, and image generation. These providers may process your information as necessary to provide their services. We do not publicly expose API keys, credentials, or private infrastructure details. The list of providers may be updated from time to time and is managed through our internal legal settings.

Availability and Changes

We may modify, suspend, or discontinue the Application, or any part of it, at any time without notice. We do not guarantee that the Application will be available at all times or free from errors.

Disclaimer of Warranties

The Application is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Application will be uninterrupted, error-free, or that AI-generated content will be accurate or reliable.

Limitation of Liability

To the maximum extent permitted by law, WS Design & Build shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Application, including but not limited to any renovation decisions based on AI-generated content.

Indemnification

You agree to indemnify and hold harmless WS Design & Build and its affiliates from any claims, damages, or expenses arising from your misuse of the Application or your violation of these Terms.

Termination and Access Restrictions

We may suspend or terminate your access to the Application at any time, for any reason, including violation of these Terms or suspicious activity. Upon termination, your right to use the Application ceases immediately.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

Dispute Resolution

If you have a concern or dispute, we encourage you to first contact us at design@wsbuild.com. We are committed to addressing concerns in good faith.

Changes to the Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Application after changes constitutes acceptance of the updated Terms.
